Terms of Service

Effective

Version

Lapometry is operated by Curious Manner, LLC, a Wisconsin limited liability company ("we", "us"). These terms are the agreement between you and us for your use of lapometry.com and the Lapometry application (the "Service"). By creating an account or using the Service, you agree to them.

1.What Lapometry does

Lapometry reads RC race timing results that timing providers publish publicly — principally LiveRC — and turns them into analysis: lap times, consistency, personal bests, progress over time, and comparisons between drivers at the same track. You can add your own notes, car setups, and private information to your account.

We do not time races. We do not operate tracks. We are not affiliated with LiveRC, with any track, or with any racing organisation.

2.Your account

You need an account to use the Service. You agree to give accurate information, to keep your password to yourself, and to be responsible for what happens under your account. One account is for one person; accounts are not shared.

You may claim a transponder number to associate published results with your account. Claiming a transponder is a statement by you that it is yours. If you claim a transponder that is not yours, we may remove the claim and may suspend your account.

3.Age

You must be at least 16 years old to use the Service. If you are under 16, do not create an account. If we learn that an account belongs to someone under 16, we will close it.

4.Subscriptions and payment

Paid plans are sold as monthly or annual subscriptions. The current plans and prices are shown on our pricing page, and the price you see at checkout is the price you pay for that term. Prices are in US dollars.

We currently sell only to customers in the United States. You may use the Service from anywhere, but we do not offer subscriptions elsewhere at this time.

Complimentary access. We may give an account free access to the Service at our discretion — for example to testers or to drivers we sponsor — and we may end that free access at any time, for any reason, without notice. Free access is not a subscription, carries no term, and nothing in section 5 applies to it.

Payments are processed by Stripe. We never receive or store your full card details.

Your subscription renews automatically at the end of each term, at the then-current price for your plan, until you cancel. If we change the price of your plan, we will tell you before the change applies to you, and you can cancel before it takes effect.

5.Cancellation and refunds

You can cancel at any time. Cancel from your account settings. When you cancel:

  • Your subscription stops renewing.
  • You keep full access until the end of the period you have already paid for. Your account shows that date.
  • We do not give refunds or credits for partial periods, unused time, or plan downgrades. This applies to both monthly and annual plans.

If you cancel an annual plan one month in, you keep the remaining eleven months of access and receive no refund. Please choose annual only if you are confident.

If a payment fails, we will try again and tell you. If it keeps failing, your access to the Service stops. Your data is not deleted. You can still sign in to download a copy of your data, to delete your account, or to subscribe again — and if you subscribe again, everything is where you left it.

There is no free version of the Service. If you want to see what Lapometry does before paying, use the public demo.

6.Plan limits

Each plan includes a number of tracks, and you can add more with the additional track add-on. If you cancel, downgrade, or remove an add-on so that you follow more tracks than your plan allows, we ask you to choose which tracks to keep within your new limit. We do not delete your historical data because of a downgrade — if you upgrade again, the tracks you set aside come back as they were.

7.What you may not do

Do not:

  • scrape, crawl, or bulk-extract data from the Service, or resell or redistribute it as a dataset or competing product;
  • try to access another user's account or data;
  • interfere with the Service, or attempt to get around its limits, locks, or paywalls;
  • use the Service to harass anyone, including by publishing pages about another racer to demean them.

8.Public pages you create

The Service lets you publish certain pages at public URLs — a shared session, a shared race result, a public driver profile. Publishing is your action. When you publish:

  • the page is public, can be read by anyone with the link, and can be indexed by search engines;
  • the page carries your display name, your username, and your results;
  • for a shared race result, the page carries the other drivers in that race, by name, with their published times — this is how a race result works;
  • you can revoke a share at any time, which stops the link working;
  • publishing requires an active subscription. If your subscription ends, the pages you have published stop working until you subscribe again. They are not deleted, and they come back as they were.

You are responsible for what you publish. Do not publish a page if you do not want it seen.

9.Third-party results and other people's data

The results that Lapometry analyses are published by timing providers, principally LiveRC, on their own public websites. Those results include the names and lap times of racers who do not have Lapometry accounts and who have not agreed to these terms.

We treat that data as what it is: results a timing provider has already made public. We attribute it on every page that shows it. We do not claim ownership of it, we do not claim any endorsement by or affiliation with LiveRC or any track, and we do not grant you any rights in it.

If you are named in results shown on Lapometry and want something done about it, write to legal@lapometry.com. Tell us who you are and what you are asking for. We will act on reasonable requests, including removing a name from public pages we control.

If a timing provider or track asks us to stop using their published data, we will engage with that request in good faith.

10.Your data and your content

Your notes, car setups, and account details are yours. You give us permission to store and process them so that we can run the Service for you, and to show the parts you choose to publish.

You can delete your account at any time from your settings. When you do:

  • every public share you have created is revoked, so those links stop working;
  • your notes, setups, username, and account details are deleted;
  • published race results that mention you remain published by the timing provider — those are not ours to delete, and we do not control them.

11.Availability

We work to keep the Service up but we do not promise it will always be available, and we may change or remove features. If we discontinue the Service entirely, we will give notice and stop charging.

Lapometry's analysis depends on data from timing providers. If a provider changes or stops publishing, some analysis may become unavailable. That is outside our control.

12.No warranty

The Service is provided "as is". We do not warrant that the analysis is accurate, complete, or fit for any particular purpose. Do not rely on Lapometry for anything that matters beyond your own racing — results, standings, and official timing come from your track and your timing provider, not from us.

13.Limitation of liability

To the fullest extent permitted by law, Curious Manner, LLC is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

14.Changes to these terms

We may update these terms. The version and effective date are shown at the top of this page. If a change is significant, we will tell account holders before it takes effect. Continuing to use the Service after a change means you accept it.

15.Governing law

These terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict-of-laws rules.
